Poppi drinkers to get checks from $8.9m ‘misleading’ settlement – exact steps to follow if you don’t have receipt


POPPI drinkers can get their hands on one-time payments from an $8.9 million settlement regarding misleading marketing claims.

The popular beverage company Poppi has wound up in an $8.9 million class action settlement[/caption]

The sparkling prebiotic drink Poppi has quickly become one of the most popular beverages in the US following its appearance on Shark Tank in 2018.

The company pulls in hundreds of millions of dollars in annual sales and continues to grow, now representing 19% market share in the prebiotic soda category, edging out competitors like Coca-Cola.

Poppi’s popularity among consumers is due to its position as a healthier, functional alternative to traditional soda, made with less sugar and calories as well as prebiotics to encourage gut health.

However, the company has come under fire for its advertising, sued over allegedly misleading marketing claims that the beverages are “gut healthy.”

Plaintiffs have argued that the drinks are made with minimal prebiotics and contain too high a sugar content to justify the company’s claims.

They claimed that the ads could put consumers at a higher risk of health issues such as obesity and type 2 diabetes.

Poppi’s former owner has agreed to shell out $8.9 million towards a class action settlement to resolve all the allegations against the brand, according to the settlement website.

While the company has yet to admit to any wrongdoing, the lawsuit has sparked questions about how healthy Poppi is, with experts proposing that such trendy “gut healthy” beverages may lead to certain cancers in the liver or colon, per Daily Mail.

ARE YOU ELIGIBLE?

Shoppers who bought any flavor or package size of Poppi drinks between January 23, 2020, and July 18, 2025, can benefit from the class action lawsuit.

Under the settlement terms, consumers are entitled to a cash payment based on the number of Poppi products they bought.


Those who provide proof of purchase can receive up to $0.75 per single can, $3 per four-pack, $6 per eight-pack, and $9 per 12- or 15-pack.

The exact amount that class members receive may vary depending on how many people file claims with the settlement.

Shoppers can submit a receipt or other documentation, such as from a store or online retailer, that demonstrates proof of purchase of Poppi products during the accepted purchase window.

Those unable to provide proof of purchase are entitled to a maximum payment of $16 per household.

What’s a class-action settlement?

Class action lawsuits offer groups of people, or ‘classes,’ a way to band together in court.

These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.

When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.

These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.

Class members are required to submit a valid claim form by September 26, 2025, to get their hands on a payment.

The deadline for exclusion and objection is the same day, while the final approval hearing for the settlement is set for November 20, 2025.

SODA SHIFT

The legal action against Poppi, which surfaced early last year, has not prevented other corporations from rolling out competing prebiotic sodas.

For example, Coca-Cola debuted its Simply Pop beverage in February in select markets, including the West Coast and Southeast regions.

The beverage giant hosted a national online rollout via Amazon Fresh and plans to bring Simply Pop to stores in other regions by the end of this year.

Similar to Poppi, Coca-Cola’s new beverage lineup is made with fruit juice and vitamins as well as prebiotic fiber, advertised as a gut healthy product.

The release came right before PepsiCo revealed its plans to purchase Poppi for nearly $2 billion. 

“More than ever, consumers are looking for convenient and great-tasting options that fit their lifestyles and respond to their growing interest in health and wellness,” PepsiCo Chairman and CEO Ramon Laguarta said at the time.

“We can’t wait to begin this next chapter with PepsiCo to bring our soda to more people – and I know they will honor what makes Poppi so special while supporting our next phase of growth and innovation.”
