Drivers to get up to $50 credit & cash payment from $3.5m ‘seat’ settlement and it can be from 17 years ago

DRIVERS could claim up to $50 in credit or a cash payout from a $3.5 million settlement over child booster seats.

Compensation is available for purchases made as far back as 2008.

The case centres on Evenflo, a US company known for car seats and baby products.

It covers anyone who bought one of its “Big Kid” booster seats between January 1 2008 and December 312022.

Shoppers accused the company of misleading advertising, arguing it promoted the seats as “side impact tested” and safe for children weighing just 30 pounds.

Evenflo, which sells car seats, strollers and other baby essentials, has not admitted any wrongdoing but agreed to settle the case.

Under the deal, parents can claim up to two booster seats.

Payments will be shared among those who come forward, with the amount depending on how many claims are made.

Instead of cash, claimants can also opt for a $25 Evenflo credit for each seat, which can be used to buy directly from the brand’s website.

Evenflo has also pledged to provide clearer information about minimum weight requirements, follow US safety regulations on child car seats and release an educational video on how to safely move children from car seats to booster seats.

The deadline to opt out or object to the deal is set for October 10 2025, while claims must be submitted by November 24 2025.

A final approval hearing is due to take place on 25 February 2026.


The case is one of several high-profile class actions to hit major brands in recent months.

Subaru recently agreed to pay $6.25 million following complaints about faulty batteries in some of its vehicles.

TikTok earlier this year reached a $92 million settlement over allegations it collected data from children without consent.

Johnson & Johnson also set aside billions of dollars to cover lawsuits linked to talc-based baby powder.

Millions of Americans could be eligible for payouts from cases like these, with many unaware they are entitled to claim.

Parents who believe they qualify for the Evenflo settlement are encouraged to check the official site and apply before the deadline next year.
