Netgain Technology is the subject of the class action, a service provider that manages IT and cloud computing services for healthcare and accounting companies.
Plaintiffs allege that Netgain failed to protect consumer information during a data breach.
The breach in question took place between September 2020 and November 2020.
The breach itself wasn’t discovered until March 2021.
According to the lawsuit, Netgain did not adequately protect personal and health-related information of consumers.
Plaintiffs argue that they are now at a greater risk of identity theft and fraud as a result of the breach.
Those impacted also say they had top spend time and money to monitor their accounts to protect themselves from fraud.
Netgain has not admitted to any wrongdoing, but has agreed to pay out the $1.9 million to settle the claims.
HOW MUCH WILL YOU BE PAID?
As per the terms of the settlement, those effected are eligible to receive up to $5,000 for documented ordinary losses as a result of the breach.
This pertains to things such as fraud or identity theft losses, credit monitoring costs, bank fees, communication charges or travel expenses.
For this, you will need proof that you have suffered a loss of this kind.
You will need to provide something like a receipt, invoice, tax form or financial document to prove a monetary loss has been suffered.
If you can not prove your loss with a documented expense, you can claim a pro rata cash payout instead.
Pro rata refers to an equal portion, so however much of the $1.9 million pot is left over will be equally split between those who are undocumented.
This total will vary on how many claimants there are, with a higher number of them meaning the money has to be split among more people.
WHEN IS THE CLAIM DEADLINE?
There is not long left for Americans to act if they want a share of the million dollar payout.
The deadline to submit a claim is fast approaching, and is set for September 17 2025.
Then, the final hearing is set for October 30.
If you cannot provide proof of a documented loss, you can still apply for a pro rata payment, but it is unclear how much you will receive.
