Crisp lovers to get chunk of $4m settlement – you just need to fill out online form & show receipt before deadline

FANS of potato chips are set to receive portions of a major $4 million class action settlement.

Customers just need fill out an online claim form to get their share of the cash.

Old Lyme Gourmet has agreed to pay the settlement to resolve claims it erroneously advertised Deep River chips as non-GMO.

This was despite the fact that the product did contain GMO ingredients, according to a class action lawsuit.

It affects customers who bought Deep River potato chips with a “non-GMO” label between February 2, 2017, and December 6, 2024.

According to the lawsuit, Old Lyme falsely advertised their snacks with a “non-GMO ingredients” graphic.

This is alleged to have tricked customers into assuming a third party such as the Non-GMO Project had certified the product.

However, Old Lyme Gourmet has not admitted any wrongdoing.

But the company has agreed to pay out a $4 million settlement to resolve the claims.

The settlement terms set out that customers can claim $5 for the first product they bought, and then $0.50 for each additional one purchased.

Customers who have proof of purchase can claim for as many products for which they can show they bought – with no upper limit.

Those without proof of purchase can claim for up to 10 products, totalling to a maximum payment of $10.

But time is running out for those looking to make a claim.

The deadline for valid claim forms to be submitted is July 28, 2025.

For proof of purchase receipts and order confirmations can be provided.

It comes as a rival to Coca-Cola is set to pay out an $8.9 million settlement to soda drinkers over a false advertising claim.

The soda brand Poppi has agreed to to pay out the multi-million-dollar settlement after allegations that it falsely advertised itself.

Poppi has also not admitted any wrongdoing, and is paying out the $8.9 million to settle the claims.

The Poppi settlement benefits consumers who purchased any flavor or package size of Poppi beverages between January 23, 2020, and July 18, 2025.

The claim deadline is set for September 26, 2025, and the final hearing will take place on November 20.
