Cosmetology panel OKs consent agreement

PIERRE, S.D. (KELO) — A woman who was licensed in Oregon to perform hair, nail and skin care must return to school for 144 hours of additional training to do those activities in South Dakota.

That’s the heart of a consent agreement between applicant Daelyn Batmale and the South Dakota Cosmetology Commission.

The state panel approved the agreement during a teleconference meeting on Monday. Batmale had signed it June 27.

The agreement says Batmale must successfully complete 40 hours in general infection control and professional standards; 85 hours in science of cosmetology, hair, skin, and nails; 11 hours in chemical hair services; and eight hours in electronic nail filing.

Batlmale also must take and pass the online National-Interstate Council written theory examination for cosmetology and take and pass the online South Dakota law and rules exam in order to be licensed in South Dakota.

Ellie Bailey, a Pierre attorney, represented Batmale, who plans to work at a Pierre salon. Bailey told the commission on Monday that Batmale has already started taking the additional coursework. Batmale had been licensed in Oregon since 2019.

Jennifer Doubledee, the commission’s attorney, said Batmale applied for reciprocal licensing in South Dakota on February 23, 2025. The commission’s program director, Tyler Evins, sent Batmale a deficiency letter on April 4, 2025, advising Batmale that South Dakota did not have an equivalent hair design license to reciprocate.

The South Dakota office received correspondence from College of Hair Design Careers (CHDC) in Salem, Oregon, on April 15, 2025, detailing the type and number of hours Oregon required and the applicant’s final progress report, syllabi, and official transcripts.

On April 17, 2025, the state office denied Batmale’s request for reciprocity, outlining the basis for the denial and advising Batmale of her right to file a written request for a contested case hearing within 20 days, or May 7, 2025.

Batmale then submitted her written request for a contested case hearing in front of the state commission on April 28, 2025, and her attorney submitted additional documentation to director Evins on May 7 in support of her reciprocity application.

On May 13, Batmale was informed through her attorney that the denial of her reciprocity
application was being maintained. The hearing was scheduled for June 13, 2025.

But the consent agreement was reached rather than proceeding to the hearing.

“Unfortunately Oregon did not have the same licenses as South Dakota, and we can’t reciprocate a license we didn’t have,” commission attorney Doubledee said Monday.

The commission at its June 16 meeting approved a consent agreement with Dwight Johnson to receive a student license. The commission had previously denied Johnson’s application because he had simple assault convictions in 2008, 2015, 2016 and 2018, including two that were felonies.
