DCI: 30 gunshots, officers justified in July 7 shooting

SIOUX FALLS, S.D. (KELO) – Three Sioux Falls Police Officers were justified in the July 7 shooting that injured a man who had shot at the officers, the South Dakota Division of Criminal Investigation (DCI) said in its report.

Deondre Gene Black Hawk, 24, and police exchanged gunfire after Black Hawk had fled and turned to shoot while being pursued, the investigation report said.

Officers fired 24 rounds while Black Hawk fired six. Black Hawk was shot multiple times.

Black Hawk initially fled from two officers and one of those officers saw that Black Hawk had a handgun. When Black Hawk was about 15 feet from the two officers, he turned at fired at them, according to the incident report. The two officers returned fire almost simultaneously. A third office joined the pursuit.

Police were attempting to find Black Hawk who was a suspect in a July 6 shooting incident and had multiple warrants. He was located on July 7 near the 200 block of North Prairie Avenue, according to the incident report. You can read the full report attached below.

Black Hawk left that area in a vehicle that stopped at an apartment building on the 100 block of South Garfield Avenue. Police found Black Hawk behind the apartment building. The pursuit started after Black Hawk fled from police.

Black Hawk had a tested blood alcohol centration of .120 and also tested positive for methamphetamine.

Black Hawk faces 13 charges in Minnehaha County for this incident. There are two counts of attempted first degree murder of a law enforcement officer, six counts of aggravated assault of a law enforcement officer, four counts of committing a felony while carrying a firearm, and one count of possession of a firearm with a prior felony drug conviction.

“The suspect fired a handgun at the law enforcement officers, and there was a clear and present danger to the officers’ safety,” Attorney General Marty Jackley said in a news release. “The officers took action to protect themselves and others.”
