GameStop, a video game retailer with stores around the US, has been accused of violating the federal Video Privacy Protection Act (VPPA).

The company is said to have done this when it shared consumer information with Facebook.

The VPPA is a set of privacy laws set up to ensure that customer information regarding viewing history and sales records is protected.

This lawsuit claims that GameStop violated the VPPA when it shared consumer information with Facebook without customers’ knowledge.

This incident allegedly involved GameStop sharing information about video game purchases, including the specific ones purchased by shoppers.

It was supposedly done via a tracking pixel on the GameStop website.

A tracking pixel is a small transparent image embedded in websites, emails and digital ads, designed to collect behavior data.

This includes things like page views and clicks, which are then sent for analysis to maximize performance.

GameStop has not admitted to any wrongdoing in this case, but has agreed to pay out the sum to settle the claims against it.

This settlement benefits those who bought a game from GameStop‘s website between August 18, 2020, and April 7, 2025.


It specifically targets shoppers who had a public Facebook profile with their actual name at the time of purchase.

HOW MUCH WILL YOU BE PAID?

Under the terms of the settlement, claimants are eligible for either financial compensation or compensation via a voucher.

Cash payments are capped at $5 per class member, and payments are capped at $10.

Class members are not able to receive both a payment and a voucher; they must pick one of the options.

What’s a class-action settlement?

Class action lawsuits offer groups of people, or ‘classes,’ a way to band together in court.

These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.

When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.

These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.

GameStop is also required to suspend use of the Facebook tracking pixel.

This change is being made to ensure GameStop is operating within the boundaries of the VPPA.

DATES TO KNOW

Note that you do not need to submit proof that you fall into the specific claimant rules.

You do not need to have purchased a video game from the website in the timeframe to receive either the payment or the voucher.

But if you do not submit a claim form by the deadline, you will not be able to claim anything.

The deadline to submit a form is set for August 15, 2025, and the final approval hearing will take place on September 18.
